ہتک عزت (Defamation) کے دعوے کے اثبات کے لیے عدالت کے سامنے دو بنیادی قانونی آزمائشیں (Tests) پوری کرنا ضروری ہیں:✍️1. معقول آدمی کا معیار (Reasonable Person Standard):عدالت یہ دیکھتی ہے کہ کیا ایک عام معقول قاری یا سننے والا متعلقہ الفاظ کو بدنام کن (Defamatory) معنی میں لے سکتا ہے۔✍️2. اثر کی سنگینی کا معیار (Seriousness of Impact Test):مدعی کو یہ ثابت کرنا ہوتا ہے کہ ان الفاظ کے نتیجے میں اس کی شہرت کو حقیقی، نمایاں اور قابلِ لحاظ نقصان پہنچا ہے۔Two tests to be applied being the reasonable person standard, assessing whether an ordinary reader would take the words as defamatory, and the seriousness of impact test, requiring proof of substantial reputational harm.C.P.L.A.4809/2024 Dr. Manzoor H.
